Coaching and tuition for QS or Commercial Management BTEC and degree students, plus civil engineering RICS APC, and CICES Review candidates. I am a practicing Review Examiner.

Methodology

My approach is based on understanding the candidate or students background and what they want to acheive and tayloring support and learning accordingly. I particulalry focus on practical examples and case studies so that students and candidates are able to apply the learning to real life problems, or further asignments and thus embed the learning and be confident. I'm naturally patient and will go at the student's own pace and try to use whatever assesment medium will be used by the examing body (TEAMs, Zoom etc). In the current pandemic conditions, all delivery will be remote.

Experience

I have over 30 years experience of quantity surveying and commercial management of construction projects. My experience spans 10 years with major consultancy and 20 years with major contractors. I have a QS degree and an MSc in Construction Law and Dispute Resolution. I have coached and acted as mentor, supervisor and counsellor for RICS APC and Institution of Civil Engineering Surveyors review candidates for over 15 years.

I am a practicing a review examiner, so am aware of the competances and standards required. I have delivered a whole range of revision and development session for people at: apprentice, degree and APC/ Professional Review level, including specialist CPD.

Business Unit Commercial Manager for Transportation business. Leading a team of commercial staff delivering a range of target cost design and build transport infrastructure projects valued at around £128m p.a. These include structures and line side works across the LNW and LNE rail routes and enabling works for HS2. Reactive emergency works are provided under framework to Network Rail. In addition, the team supports a £10m p.a. multi utility connections business, which operates nationally on major housing and commercial developments. A range of Contract types and Forms are operated including Lump Sum target cost and cost reimbursement on NR/ICC, ECC and other bespoke forms of contract. Experience of recovery of WIP and debt in a rapidly changing market.


Dec 17 to June 19 J Murphy & Sons
Snr Commercial Manager covering power projects in across the UK. Projects consisting of a range of FIDIC and NEC based contracts lump sum contracts for cabling and substation works, ranging in value from £4m to £100m. Also responsible for bespoke framework for electricity DNO fault repair at LV and HV. Responsibilities include tender input, subcontract procurement, cost value reconciliation, WIP control, cost management with a subcontract and direct labour delivery organisation, variations, claims preparation and defence and dispute resolution. This was a NEC target cost based framework covering gas mains replacement, alterations and diversions and provision of resource to Cadent. Role covers subcontract procurement (Over £100m p.a.), cost and value management and forecasting, commercial controls, SRM, claims preparation and defence and risk management. Team includes 43 staff at all levels, based in the North West and West Midlands.

Sept 14 to Oct 15 Balfour Beatty Utility Solutions
Snr Commercial Manager in dual role as Framework Commercial Manager for United Utilities Network Construction Alliance. The Alliance organisation is integrated with United Utilities and was charged with delivery of a £400m capital programme of water and waste water network and water and waste water treatment assets, over a 5 year period. The programme included a wide range of projects from trunk mains, M & E and process plants to shafts and tunnels. I managed a team of commercial staff and dealing with a large range of matters including: budgeting, final accounts, audit, claims preparation and presentation, insurance matters, process improvement, dispute resolution, and subcontractor relationship management.

I also provided internal training on contract forms and related subjects, as well as being the ‘owner’ of the Chartered ICES Approved Development Scheme for Commercial Staff in the Balfour Beatty Gas and Water Business.


Apr 10 to Sept 14 Balfour Beatty Utility Solutions
Business Strategy and Compliance Manager for the United Utilities Network Construction Alliance. My team was responsible for driving improvements in: business efficiency (On target to achieve £40m savings), business planning, risk management, innovation (design for manufacture and off-site assembly programmes), insurance claims, third party litigations, Streetworks, regulatory and commercial compliance, quality assurance, subcontractor and supplier performance management.



Aug 06 to Mar 10 Balfour Beatty Utility Solutions
Senior Commercial Manager with responsibility for a multi-utility contract for capital works and repair and maintenance, covering water and waste water network and electricity distribution.

Successes include; expanding the scale of Works delivery to £120m p.a., introduction of effective commercial controls, reducing debtor days to below 20, improving contract contribution by 75%, supply chain transformation, and leading commercial negotiation and close out of award of the £400m AMP5 NCA Contract. Experience includes: budgeting, final account programmes, tendering, subcontract procurement and claims, main contract claims, TUPE In and Out, insolvency, litigation and mediation, insurance claims and disputes.

Acted as Framework Manager with responsibility for over 600 staff and operatives across both Repair and Maintenance and Project Works on Water, Waste Water and Electricity networks.

Seconded to Atco Electricity Alliance in Edmonton, Canada, to address issues on commercial performance and reporting. The Alliance constructed a 270km EHV transmission line across Alberta with primary transformer stations.

Procurement Manager implementing a programme of M, E & I equipment and process technology supply and installation frameworks. Responsibilities include setting up EU regulation compliant processes, contract drafting and negotiation across; pricing, insurance, liability and performance issues. Also developing and delivering training on impact of 2006 Procurement regulations. Advising on IPR issues on UU's main construction delivery partnerships.

IT and Financial Services Outsourcing
IT contracts with management role including: management of the procurement, negotiation and contract administration of UU's ITFM shared services contract (>£113m), closeout of the existing contract (£200m), including preparation for audit closeout of associated offshore development term contract. Negotiation of major changes and extensions to customer contact and financial services contract (£45m p.a.).


Aug 04 to Oct 04 United Utilities
Claims coordinator for AX3 programme. Specifically responsible for management of business line input to a >£80m multi-party litigation concerning under performing capital investment projects and provision of contract and project management support to in house legal team and instructing solicitors.. Also responsible for coordination of the Company's response to a multi £m group legal action by members of the public complaining of public nuisance.


Sept 03 - Aug 04 United Utilities
Procurement and Contracts Manager for UU's £2bn AX4 Capital Programme. Responsible for the development and early stage implementation of the procurement and contract strategy for the whole of the AMP4 and XD4 Capital and Opex spend programmes. Role included the management of a team of commercial professionals implementing the strategy, coordination with our legal advisors and related IS projects, support to the Organisation, Business Process and IT work streams, briefing UU staff and other stakeholders on proposals. Range of strategies developed ranging from: major long term alliances for major works design and construction and utility street-works, term contracts, to lump sum fixed priced contracting.


2002 - Sept 2003 United Utilities
Contracts Manager for Asset Delivery. Responsible for all commercial matters within Asset Delivery (£500m p.a. investment programme). Managing a team of commercial professionals covering; the management of the MWH ESP contract (>£200m), 43 M & E Kit framework supply contracts (worth over £160m, including work carried out offshore), 3 major construction framework contracts, multiple non-framework contracts and functional responsibility for commercial aspects of the Capital Maintenance (internal small works engineering design, procurement and supervision) business. Introduced benchmarking and supply chain integration to take £30m out of the Capital spend of the major frameworks along with demand forecasting for the Kit framework including ODC, and formal performance reviews for the ESP.


2000 to 2002 Wood Group
Contracts Manager (Commercial) initially covering a range of nuclear related Business Teams including Reactor services, Decommissioning, Defence, and Environmental and Lab Services. Role included tender preparation, negotiation of prime contracts with Foster Wheeler's Clients, developing sub-contract procurement strategies for significant programmes, drafting and negotiation of subcontract documentation (Including teaming and enabling agreements), preparation and negotiation of significant variations and claims, chairing tender reviews, and developing commercial strategies, risk workshop facilitation and risk management.
